                                     HOUSE CONCURRENT RESOLUTION NO. 157
REQUESTING THAT THE STATE LOTTERY OFFICE PROVIDE A REPORT ON ILOTTERY.
1WHEREAS, the General Assembly authorized iLottery over a decade ago through the Delaware Gaming
2 Competitiveness Act of 2012; and
3WHEREAS, the General Assembly is concerned about the impact iLottery will have on retailers and the long-term
4 impact on their sales; and
5WHERAS, lottery retailers have been partners with the state lottery for the last 50 years, collecting over $320 million
6 in revenue for the State of Delaware in the past 5 years alone.
7NOW THEREFORE:
8BE IT RESOLVED by the House of Representatives of the 153rd General Assembly of the State of Delaware, the
9 Senate concurring therein, that the General Assembly is requesting that the State Lottery Office submit a report to the Chief
10 Clerk of the House of Representatives, the Secretary of the Senate, and the Director and the Librarian of the Division of
11 Legislative Services to be distributed to all members of the General Assembly by February 15, 2027, containing all of the
12 following:
13(a) Data showing in store Lottery and iLottery sales in Delaware since iLottery implementation until the end of 2026
14 including lottery revenue data from the past 10 years for reference.
15(b) An analysis of revenue difference from iLottery with non-affiliate retailers and affiliate program retailers.
16(c) Data showing the revenue to the state from iLottery, amount paid to any vendors for the creation and ongoing
17 implementation of iLottery, and the amount and description of any additional expenses regarding iLottery from conception
18 through the end of 2026.
19(d) The amount of promotional dollars spent by the state or state’s vendor to promote iLottery and the timeline and
20 amounts for planned future spending.
21BE IT FURTHER RESOLVED, the report shall also include an analysis of the financial impact of implementing
22 the following options supporting retailers in physical stores:

23(a) Reserving PowerBall and MegaMillions to only be available in physical stores and not online.
24(b) Reserving other game combinations to only be available in physical stores and not online including but not
25 limited to instant win ticket games or a certain split between the number allowed online and the number offered in physical
26 stores.
27(c) Creating a fund based on a share of newly generated iLottery revenue to be provided to retailers.
28(d) Increasing commissions for retailers across the board at various levels based on a factor of iLottery revenue.
                                                          SYNOPSIS
         This House Concurrent Resolution calls on the State Lottery Office to submit a report to the General Assembly by
January 15, 2027, detailing iLottery data and analyzing options to expand support for traditional lottery retailers in the future.
