WILLIAMS, MERSKI,PARKER, RUSNOCK, BOYD AND INGLIS, AUGUST 27, 2026REFERRED TO COMMITTEE ON JUDICIARY, AUGUST 27, 2026AN ACT1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania2 Consolidated Statutes, in human trafficking, further3 providing for asset forfeiture.4 The General Assembly of the Commonwealth of Pennsylvania5 hereby enacts as follows:6 Section 1. Section 3021(d) and (m) introductory paragraph of7 Title 18 of the Pennsylvania Consolidated Statutes are amended8 and the section is amended by adding subsections to read:9 § 3021. Asset forfeiture.10 * * *11 (a.1) Mandatory forfeiture.--In addition to property subject12 to forfeiture under subsection (a), if a person is convicted of13 a violation of this chapter, the court, in imposing sentence,14 shall order the person to forfeit to the Commonwealth the15 person's interest in any of the following:16(1) Real or personal property that was involved in, used17 or intended to be used to commit or facilitate the commission18 of the violation and property traceable to the property.1(2) Real or personal property that constitutes or is2 derived from proceeds that the person obtained, directly or3 indirectly, as a result of the violation and property4 traceable to the property.5 * * *6 (d) Transfer of property.--If property is forfeited under7 this section, the property shall be transferred to the custody8 of the district attorney if the law enforcement authority9 seizing the property has county or local jurisdiction, or the10 Attorney General if the law enforcement authority seizing the11 property has Statewide jurisdiction. The Attorney General or12 district attorney, where appropriate, may sell the property. The13 proceeds from a sale shall first be used to pay all proper14 expenses of the proceedings for forfeiture and sale, including15 expenses of seizure, maintenance of custody, advertising and16 court costs. The balance of the proceeds shall be distributed17 under [subsection (m)] subsections (m) and (m.1).18 * * *19 (m) Disposition of proceeds.--Subject to subsection (d), all20 moneys forfeited and the proceeds from the sale of all property21 forfeited and seized under this section shall be paid as22 follows, except as provided under subsection (m.1):23* * *24 (m.1) Restitution priority.--25(1) The Attorney General or district attorney, where26 appropriate, shall transfer money, property or proceeds27 forfeited under this section to satisfy an order of28 restitution arising from a violation of this chapter.29(2) A transfer under paragraph (1) shall have priority30 over a distribution under subsection (m) to a law enforcement20260HB2752PN3844 - 2 -1 agency, the office of the prosecuting attorney or the2 commission.3(3) A transfer under this subsection shall not reduce or4 otherwise mitigate the obligation of a person convicted of a5 violation of this chapter to satisfy the full amount of an6 order of restitution through nonforfeited assets.7 * * *8 Section 2.
