Legislation approved by the U.S. House this week could benefit the developing lithium industry in South Arkansas by expanding access to a federal process intended to accelerate permitting for mining and mineral-processing projects.
The House passed the Protecting Domestic Mining Act of 2025 last Wednesday, August 2nd, by a vote of 218-201. The legislation would formally include mining and mineral processing among the types of projects eligible for coordinated federal review under the FAST-41 permitting process.
Fourth District Congressman Bruce Westerman, who chairs the House Committee on Natural Resources, said Thursday the legislation could have a direct impact on development of Arkansas’ lithium resources.
FAST-41 does not eliminate federal environmental reviews or other permitting requirements. Instead, the process establishes coordinated review schedules and milestones among federal agencies for qualifying projects.
Westerman said that could become increasingly important as South Arkansas looks beyond extracting lithium to potentially developing additional processing and manufacturing operations associated with the mineral industry.
The legislation would codify mining and mineral processing as covered sectors under FAST-41. It would also block implementation of a previously proposed rule that would have limited mining projects eligible for the process to those involving critical minerals.
The potential impact comes as South Arkansas’ lithium industry continues moving toward commercial production.
The Southwest Arkansas Project, a joint venture between Standard Lithium and Equinor, is being developed in Lafayette County using lithium-rich brine from the Smackover Formation.
The project is designed to produce approximately 22,500 metric tons of battery-quality lithium carbonate annually over an anticipated 20-year operating life.
That project has already experienced the type of federal review process addressed by the legislation.
The Southwest Arkansas Project completed its federal permitting process under FAST-41 in May, with the U.S. Department of Energy serving as the lead federal permitting agency.
Commercial development has also continued in recent days.
Smackover Lithium announced August 31st that it signed a binding agreement to supply LG Energy Solution with 8,000 metric tons of battery-quality lithium carbonate annually for 10 years after commercial production begins.
The agreement is estimated to be worth approximately $1.5 billion over that period.
Combined with an earlier agreement with Trafigura, approximately 90% of the project’s targeted customer offtake volume has now been committed.
The partnership is targeting a final investment decision this year, with construction planned to begin afterward and commercial production currently expected in 2029.
While the Southwest Arkansas Project has already completed its federal permitting process, Westerman said the broader legislation could benefit future lithium extraction, processing and manufacturing projects developed in the region.
The Protecting Domestic Mining Act now moves to the Senate for consideration.
