This comes after the Missouri Supreme Court decided on Thursday to put a gerrymandered congressional map on November's ballot and use the 2022 election map for the Nov. 3 election, according to previous KOMU 8 reporting.

U.S. Rep. Bob Onder, R-Mo., and state Sen. Rick Brattin, R-Harrisonville, who are both currently running for the House of Representatives, led the charge in filing the appeal to Missouri's Eastern District Court.

The Missouri Supreme Court has ordered the secretary of state to place the state's gerrymandered map, as well as Amendment 6, on the November ballot.

Onder and Brattin said they each have "an interest in a fair and accurate election process" because they are candidates, according to court documents.

"This filing is about protecting Missourians' constitutional rights and ensuring that federal law is followed in the upcoming general election," Brattin wrote in a news release.

Two registered Missouri voters, Pat Thomas and Debra Havens, are also listed as plaintiffs, according to court records.

It alleges that Thomas and Havens, along with "hundreds of thousands of registered voters," voted in the Aug. 4 primary under the Missouri First map and will be moved into different districts for the November election.

The candidates also said they won nominations by advocating to a particular set of voters under the Missouri First map, meaning they must appeal to many new voters they have not campaigned for yet, according to the complaint.

"The entire State of Missouri has now been plunged into legal and electoral uncertainty over which Congressional maps govern Missouri’s 2026 general election and which candidates represent whom," the complaint reads. "This Court should issue all appropriate relief without haste to ensure free and fair elections in November."

The lawsuit names Secretary of State Denny Hoskins as a defendant, as well as his office and the state of Missouri, according to court documents. In his role, Hoskins oversees Missouri's elections.

Hoskins refused to certify the ballot measure in August, claiming that despite a campaign collecting more than 300,000 votes, the item itself was unconstitutional and could not go on the ballot, according to previous KOMU 8 reporting.

The Missouri First map, passed in 2025, redrew the state's congressional district lines in a way that would likely give the GOP another seat from Missouri in the U.S. House of Representatives.

Missouri Attorney General Catherine Hanaway filed an appeal to the U.S. Supreme Court on Friday night requesting a stay in the court's order, according to previous reporting.

The state previously applied to the Missouri Supreme Court for a stay, which it denied on Friday.

Missouri GOP leaders are pushing to gerrymander Missouri's congressional map and change how voter-approved measures become laws.

People Not Politicians, the group that brought forward the ballot measure, claimed Hanaway and other state officials risk undermining citizen voices.

"The Eastern District should reject this charade and scold their petitioners for their attempted manipulation of the judicial system for a political goal," the group wrote in a news release.

Tuesday is the deadline for the November ballot to be finalized.
