11 RELATING TO PUBLIC SCHOOLS; ADDING A PERMITTED USE FOR MONEY IN
12 THE TRANSPORTATION EMERGENCY FUND.

14 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
15 SECTION 1. Section 22-8-29.6 NMSA 1978 (being Laws 1995,
16 Chapter 208, Section 15, as amended) is amended to read:

17 "22-8-29.6. TRANSPORTATION EMERGENCY FUND.--

18 A. The "transportation emergency fund" is created
19 in the state treasury. Money in the fund shall not revert to
20 the general fund at the end of any fiscal year. Money in the
21 fund is appropriated to the department for the purpose of
22 funding transportation emergencies, including fuel price
23 increases and grants to small rural school districts for the
24 purchase of buses for student activities. The secretary shall
25 make distributions to ensure the safety of students receiving

2 B. The secretary shall account for all
3 transportation emergency distributions and shall make full
4 reports to the governor, the legislative education study
5 committee and the legislative finance committee of payments
