 Surface water drainage utilities.

                                       for
1 AN ACT relating to cities and towns; clarifying that cities
2 and towns are required to comply with provisions applicable
3 to     surface     water        drainage     utilities     as   specified;
4 specifying       applicability;  requiring     elections;       and
5 providing for an effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:
8
9Section     1.    W.S.    15-7-101(a)(iii)(B)       is   amended    to
10 read:
11
1215-7-101.        Purposes.
13
14(a)   In addition to all other powers provided by law,
15 any city or town may make public improvements as follows

1 for which bonds may be issued to the contractor or be sold
2 as provided in this chapter to:
3
4(iii)   Take    any    action   necessary        to   establish,
5 purchase, extend, maintain and regulate a water system for
6 supplying water to and diverting surface water runoff from
7 its inhabitants and their property and for any other public
8 purposes, including:
9
10(B)   Prescribing        and   regulating        of   rates
11 for:
12
13(I)    The use of water; and
14
15(II)       The   diversion    or   management      of
16 surface water runoff in compliance with the Surface Water
17 Drainage Utility Act and after an election as required by
18 W.S. 16-10-105; and
19
20Section 2.

22(a)   Any municipality        that adopted any  ordinance or
23 resolution for the collection of fees, costs or taxes for

1 the diversion or management of surface water prior to July
2 1, 2026 and that did not hold an election pursuant to W.S.
3 16-10-105 for the approval of the means of financing the
4 surface water diversion or management system shall:
5
6(i)    Hold   an    election    as    required     by    W.S.
7 16-10-105 not later than July 1, 2027;
8
9(ii)     If   the    electors    do      not     adopt   the
10 proposition      submitted     under    paragraph     (i)     of    this
11 subsection, the municipality shall cease the collection of
12 any fees, costs or taxes for financing the surface water
13 diversion or management system not later than sixty (60)
14 days following the results of the election.

16Section 3.    This act is effective July 1, 2026.
